Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Rose Seeds website and any account-based features (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to create an account or use the private features of the Service. By using the Service you represent that you meet this requirement.

2. Your account

You are responsible for keeping your login credentials, codename, and safety key confidential and for all activity that occurs under your account. Notify us immediately at hello@roseseeds.org of any unauthorized use.

3. User content

You retain ownership of the messages, letters, journal entries, group posts, and other content you submit ("User Content"). You grant Rose Seeds a limited, worldwide, royalty-free license to host, store, transmit, and display your User Content solely to operate the Service for you and the recipients you choose.

You are solely responsible for your User Content. You represent that you have the right to submit it and that it does not violate any law or third-party right.

4. Prohibited conduct

You agree not to use the Service to:

Harass, threaten, stalk, dox, or endanger any person.
Post content that is unlawful, defamatory, sexually explicit involving minors, or that incites violence.
Impersonate any person, staff member, or organization, or use reserved names (e.g. "admin", "support").
Attempt to access another user's account, break authentication, or bypass rate-limits or security controls.
Scrape, mass-download, reverse engineer, or interfere with the operation of the Service.
Use the Service to solicit, sell, or promote commercial products or services without written permission.

5. Reporting and moderation

You can report other users or content via the in-app report tool. We may — but are not obligated to — review, remove, or restrict any content or account at our discretion, with or without notice.

6. Not a professional service — no medical, legal, or emergency advice

The Service is a peer community. Nothing on Rose Seeds is medical, mental-health, legal, financial, or safety advice. We are not therapists, doctors, lawyers, or first responders. If you are in immediate danger or having a medical or mental-health emergency, call 911 (US) or your local emergency number. See our Disclaimer for more.

7. Monitoring, removal, suspension & termination

We reserve the right, at our sole discretion and without prior notice, to:

Access, review, and monitor any content submitted to the Service — including group posts, circle threads, and private messages — in order to enforce these Terms, investigate reports, and comply with the law.
Remove, edit, or restrict access to any content for any reason, including content we believe promotes or facilitates illegal activity (such as the sale or exchange of drugs, weapons, or other unlawful goods or services), abuse, harassment, spam, sexual content involving minors, or violations of these Terms.
Suspend, ban, or permanently terminate any account at any time, with or without notice, and with or without cause, and with no obligation to refund anything.
Report suspected illegal activity to law enforcement and cooperate with any investigation or legal process.

You may delete your account at any time from Settings. Termination does not limit any of our other rights or remedies.

7a. Service availability & right to shut down

Rose Seeds reserves the right, at any time and at our sole discretion, to modify, suspend, limit access to, or permanently discontinue the Service — in whole or in part — with or without notice. This includes the right to take the Service offline permanently if we determine, in our sole judgment, that it is no longer safe, sustainable, lawful, or appropriate to operate for the public. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service, or for any loss of content, data, or opportunity resulting from it.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL BE SECURE, ERROR-FREE, OR AVAILABLE AT ANY PARTICULAR TIME.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROSE SEEDS AND ITS OWNERS, OPERATORS, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, USER CONTENT, OR ANY INTERACTION WITH ANOTHER USER — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless Rose Seeds and its owners and operators from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your User Content, your use of the Service, or your violation of these Terms or any law.

11. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction there. You and Rose Seeds each waive any right to a jury trial and to participate in a class action to the extent permitted by law.

12. Changes

We may update these Terms at any time. Material changes will be posted here with a new "last updated" date. Continued use after changes take effect constitutes acceptance.
